IMPORTANT NOTICE: PLEASE READ CAREFULLY
DIVVIO IS A SOFTWARE PROVIDER, NOT A LAW FIRM. WE DO NOT PROVIDE LEGAL ADVICE.
These Terms of Service ("Terms") govern your use of the Divvio web application and services ("Service"), operated by Kintela Ltd ("we", "us", "our"). By accessing or using Divvio, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Divvio is a self-help document preparation tool. We provide a platform for you to input your financial information and generate a Form E (Financial Statement) in a PDF format suitable for family court proceedings in England and Wales.
Assisted Review is not included automatically in the Couple Bundle. If both spouses want Assisted Review, each person must purchase it separately for their own Form E and accept the Assisted Review scope before checkout.
Assisted Review does not include:
We are not a law firm and are not regulated by the Solicitors Regulation Authority (SRA). The content, guidance, Assisted Review, and "AI Co-pilot" features provided are for informational and document-preparation purposes only and do not constitute legal advice.
Use of Divvio does not create a solicitor-client relationship. Your communications with us are not protected by legal professional privilege.
You are solely responsible for:
The final PDF output is a direct reflection of the data you input. We do not verify, audit, or check your data for legal sufficiency, errors, or omissions.
Divvio is designed to generate a PDF using the standard Form E (01/23) structure and layout. This does not mean that the content you enter is legally sufficient, strategically advisable, or free from errors.
If a formatting or layout error caused by our software prevents you from using the generated PDF, we will:
This is your sole and exclusive remedy for formatting or layout issues. We are not liable for rejections based on the content of your answers, missing attachments, or procedural errors on your part.
You acknowledge that Form E requires "full, frank, and clear disclosure" of your financial circumstances. Deliberate concealment or a false statement may lead to contempt proceedings, adverse costs or other legal consequences. Divvio is not liable for a user's deliberate concealment of assets.
You are responsible for gathering and attaching the necessary evidence (bank statements, P60s, valuations) as indicated in the "Document Checklist." Divvio does not obtain these documents for you.
If you enter or upload information about a child, spouse, former partner or any other person, you must include only information that is relevant to your financial disclosure and that you are entitled to provide. You should redact unrelated information and must not use Divvio to disclose another person's information for an unrelated purpose.
Joining a mediation case does not by itself share your Form E answers or supporting documents. Any sharing of progress, completed figures, a financial schedule or current Form E attachments is governed by the separate choices shown in Divvio and explained in our Privacy Policy. You remain responsible for reviewing your disclosure and attachments before granting or renewing that permission. The named mediator or practice acts as an independent controller from the point it can access information. Divvio provides the platform and does not act as the mediator.
Fees for Self-Serve, Couple Bundle, and Assisted Review are payable at the point of export, checkout, or account upgrade. Assisted Review is priced per person and per Form E, and is not automatically included in the Couple Bundle. Guided Completion Support is enquiry-only and subject to separate written agreement. Prices are inclusive of VAT unless stated otherwise.
Self-Serve and Couple Bundle purchases include a 14-day money-back guarantee. If you request a refund within 14 days of payment and before downloading your final PDF, we refund you in full, automatically. If you have already downloaded your final PDF, refund requests are reviewed individually rather than guaranteed automatically. When a refund is issued, paid access to the Service ends. The automatic guarantee may be used once per customer. Assisted Review is refundable in full until the review has been delivered; once delivered, the review element is non-refundable, though the included Self-Serve element remains covered by the terms above. The settlement snapshot is supplied immediately with your consent and sits outside this guarantee except where defective. Your statutory rights are unaffected. Full details are in our Refund Policy.
Nothing in these Terms limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory statutory rights. Subject to that, our total liability to you for claims arising out of these Terms or the Service (whether in contract, tort, or otherwise) is limited to the greater of £100 and the amount paid for the affected Service.
We shall not be liable for:
The "AI Co-pilot" provides automated suggestions based on patterns. We do not verify the accuracy of AI-generated text or explanations. You must review all AI suggestions before accepting them.
We use provider-managed encryption at rest and TLS for data in transit, together with access controls appropriate to the service. However, no internet transmission or storage system is 100% secure.
You may permanently delete your account through your dashboard. This removes your Divvio sign-in, profile, personal Form E drafts and stored Form E files. Limited consent, access, security, accounting or versioned mediation records may instead be detached from your account and anonymised or retained under the periods in our Privacy Policy. A mediator's separately controlled copy cannot be recalled through this process.
Read our Privacy Policy for the applicable purposes, retention periods and your rights.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
